If your business has fewer than 50 full-time equivalent employees, no — you are not required to offer health insurance, and you don’t face any penalty for not offering it. The ACA’s employer mandate, formally the Employer Shared Responsibility Payment, only applies to businesses with 50 or more full-time equivalent employees.   • Complying with Flexible Spending Account rules if you offer an FSA.
  • Meeting reporting requirements if your business self-insures rather than purchasing a fully-insured plan.
